District-sessions judge allows Pradip Dutta Roy’s medical custody; will be shifted to SMCH

Today, Barak Democratic Front’s chief convener Pradip Dutta Roy’s lawyers moved to the court of District and Sessions Judge, Dhrupad Kashyap Das. Roy’s lawyers appealed for bail on medical grounds or Medical Custody as he has recently undergone Liver Transplant.

The lawyers also argued the other case against him where the Cachar Police through a suo moto filed FIR alleges that he has assaulted the media personnel. The judge was furnished a petition signed by at least 10 journalists where it’s stated that there was no such incident in the premises of the SP Office.

After going through the argument, Dhrupad Kashyap Das summoned the jail superintendent, medical officer of jail to the court to understand if the requisite medical facilities can be provided inside the Silchar Central Jail.

Eventually, after taking all affairs into account, the court approved the petition to send Pradip Dutta Roy to Medical Custody. The court has instructed the jail authorities to transfer him to Silchar Medical College and Hospital. Dutta Roy will be kept inside a separate cabin with an attached washroom as that is the mandatory minimum considering his medical condition. Two police officials will guard the cabin and only family members will be allowed access, ruled the court.

Rajesh Dhar, Victor Das, Arpan Roy, Priyanka Roy assisted Soumen Choudhury in this case. Apart from Choudhury and his team, Deepak Deb, Dhruba Saha, Abdul Hai Laskar, secretary of the Bar Association, senior advocate Imad Uddin Bulbul also argued for Pradip Dutta Roy. “We specifically appealed to the court that Pradip Dutta Roy is prone to infections as he has undergone Liver Transplant and the Court considered our prayer,” said Soumen Chouhdury.

November 27, 2021, at the stroke of midnight, Pradip Dutta Roy was sent to judicial remand “jail hazat” till December 10, 2021 by the chief judicial magistrate.

Court has called for the Case Diary and the bail plea will be heard after the Case Diary is submitted by the Police on December 6. The case has been listed for hearing on December 10.
